Proglo Shipping - Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the services provided by Proglo LLC (“Proglo”, “we”, “us”, or “our”) through our website and platform (collectively, the “Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Eligibility
To use Proglo's Services, you must be at least 18 years old or the age of majority in your jurisdiction. By accessing or using our Services, you represent that you meet this requirement.
3. Service Overview
Proglo offers a cloud-based shipping solution that includes, but is not limited to, shipping label generation, multi-carrier support, order import from e-commerce platforms, fulfillment workflows, and beta features under development. While Proglo only provides its services to users based in the United States, labels may be generated for domestic or international shipping.
4. Pricing and Payment
Proglo operates on a pay-per-use basis. You are charged for each shipping label generated, with pricing displayed within the platform interface at the time of transaction. By using the Services, you authorize us to charge your provided payment method for applicable label generation fees and any optional services selected.
5. Account Management
To access most features of our Services, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to provide accurate and complete information and to update it as necessary.
6. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not misuse the Services or use them to engage in fraudulent, illegal, or harmful activities.
7. Intellectual Property
All content, software, trademarks, and other intellectual property provided through the Services are the property of Proglo or its licensors. You may not reproduce, modify, distribute, or create derivative works without prior written consent.
8. API and Beta Features
Proglo may provide access to APIs and beta features for testing and feedback purposes. These features are provided "as is" and may be modified or discontinued at our discretion. You agree not to disclose information about beta features and to provide feedback if requested.
9. Data Privacy
Proglo’s collection and use of personal information are governed by our Privacy Policy. By using our Services, you consent to such collection and use.
10. Termination
Proglo may suspend or terminate your access to the Services at any time, with or without cause. You may cancel your account at any time through your account settings.
11. Limitation of Liability
To the fullest extent permitted by law, Proglo disclaims liability for any indirect, incidental, or consequential damages arising out of your use of the Services. Proglo’s total liability for any claims shall not exceed the amount paid by you for the Services giving rise to the claim.
12. Modifications
We may revise these Terms from time to time. The most current version will always be posted on our website. Continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree to submit to the jurisdiction of courts located in Travis County, Texas for any disputes arising out of or relating to these Terms or the Services.
